Payment Terms

These Payment Terms of Service (“Payment Terms”) constitute a binding legal agreement between you and TolCamp Payments to govern the Payment Services (defined below) conducted through or in connection with the TolCamp Platform. References in these Payment Terms to “TolCamp Payments”, “we”, “us”, “our” or “our” refer to the TolCamp Payments company with whom you contract for Payment Services.

1. Overview

TolCamp Payments provides payment services to Members for publishing, offering and booking Accommodation or other Host Services through the TolCamp Platform. These services are provided for the benefit of Facility Owners and may include the following:

Receive payments from customers (“Payin”): Using the payment method associated with the TolCamp account (“Payment Method”), such as a credit card, debit card, bank account or installment product provided by a credit provider.
Paying Facility Owners: Paying to a financial instrument (such as a bank account, prepaid card or debit card) associated with the Facility Owner's TolCamp account (“Payment Method”).
Paying to a third party Payment Method: Designated by the Facility Owner.
Donation collection and payment: Charitable purposes.
Other payment services: Linked to the Platform Services.

2. Terms of Use

2.1 Compliance and Accountability

You must be at least 18 years old to use the Payment Services,
You have a TolCamp account in good standing in accordance with the TolCamp Terms of Service (“Terms”),
You must keep your payment and personal information accurate and complete.

2.2 Payment Methods

Add: When you add a Payment Method to your TolCamp account, you may be asked to provide billing information. You authorize TolCamp and its payment service providers to collect and store your Payment Method information.
Verification: When you add or use a new Payment Method, TolCamp may ask you for additional information to verify it or authorize nominal amounts from your Payment Method.
Payment Authorization: You authorize TolCamp Payments to charge your Payment Method directly or indirectly for all fees (including applicable taxes) due in connection with your TolCamp account.
Automatic Update: If your Payment Method's account information changes as a result of a re-payment or other transaction, TolCamp may automatically update it.

2.3 Reservation and Payments

Payment Timing: TolCamp Payments usually collect the Total Price after the Property Owner has accepted your booking request. Different timing may apply for instant payment methods.
Currency: The currencies available for making payments may be limited depending on the Payment Method you choose, your country of residence and other factors.
Exchange Rate: If you pay in a currency other than the billing currency of your Payment Method, your bank or credit card company may apply an exchange rate.
Reservation Request Rejection: If a requested booking is declined or you cancel, any amounts received by TolCamp Payments that should have been refunded to you will be refunded to your Payment Method.
Payment Restrictions: TolCamp reserves the right to refuse or limit payments that violate its risk management policies or are believed to be illegal or unauthorized.

2.4 Third Party Services and Providers

Third Party Services: The Payment Services may contain links to third party websites or resources. TolCamp is not responsible for the use of such Third Party Services.
Payment Service Providers: Payment Methods may include the use of third party payment service providers. These providers may charge additional fees and TolCamp is not responsible for such fees.

3. Facility Owner Requirements

3.1 Payment Collection and Timing

TolCamp Payments collect the Total Price of the booking when the Customer's booking request is accepted by the Property Owner or when the booking is automatically confirmed.
Payments are usually sent to the Owner's Payment Method within a certain period of time after the end of the Client's planned stay.

3.2 Applicable Payment Method and Information

Facility Owners must have a valid Payment Method in their TolCamp account in order to receive payment.
All requested information regarding the Payment Method must be provided and TolCamp may request additional information at any time.

3.3 Payment Restrictions and Currency

TolCamp Payments may temporarily hold, suspend or cancel payments for reasons such as preventing illegal activities, conducting a risk assessment, or being unable to verify your identity.
TolCamp Payments will send your payments through the TolCamp Platform in the currency of your choice, but available currencies may be limited.

3.4 Payment Limits, Providers and Use of Funds

For compliance or operational reasons, TolCamp Payments may limit the amount of Payments.
Payment Methods may include the use of third-party payment service providers, and these providers may charge additional fees.
TolCamp may aggregate amounts collected from Customers and invest those amounts to the extent permitted by applicable law.

4. Appointment of TolCamp as a Limited Payment Collection Agent

Each Facility Owner appoints TolCamp as the Facility Owner's payment collection agent for the limited purpose of accepting and processing payments from Customers who purchase Facility Owner Services on the Facility Owner's behalf.
Each Facility Owner agrees that payment made by a Customer through TolCamp Payments will be treated the same as payment made directly to the Facility Owner.
Each Customer agrees that TolCamp acts as each Facility Owner's payment collection agent and accepts payments on behalf of Facility Owners.

5. General Conditions

5.1 Fees and Payment Authorizations

TolCamp Payments may charge fees for the use of certain Payment Services.
You authorize TolCamp Payments to collect from you any amounts due under these Payment Terms and/or Terms.

5.2 Collections and Payment Processing Errors

If TolCamp is unable to collect the amount you owe under the Terms and these Payment Terms, it may engage in collection efforts.
TolCamp will take steps to correct any payment processing errors of which it becomes aware.

5.3 Reimbursements and Claims

All refunds or credits due to a Member under the Terms of Service will be initiated and posted by TolCamp Payments in accordance with these Payment Terms.
If you are responsible for Damage Claim amounts, TolCamp Payments may collect such amounts from you.

5.4 Abandoned Property and Prohibited Activities

If TolCamp has money due to you and that money is not accessed for a certain period of time, TolCamp may act in accordance with unclaimed property laws.
You are responsible for complying with all applicable laws when using the Payment Services and may not engage in prohibited activities.

5.5 Force Majeure, Disclaimer and Liability

TolCamp shall not be liable for delays or non-performance of obligations caused by events beyond its reasonable control (“Force Majeure”).
The Payment Services are provided “as is” and TolCamp makes no warranties of any kind, express or implied, to the fullest extent permitted by law.
Your access to and use of the Payment Services is at your own risk.

5.6 Compensation, Modification, Termination

You agree to indemnify TolCamp and its affiliates against any claims arising out of your violation of these Payment Terms or your improper use of the Payment Services.
TolCamp may change these Payment Terms at any time.
This agreement remains in effect until terminated by you or TolCamp.
TolCamp may suspend or terminate your access to the Payment Services if you violate these Payment Terms or if TolCamp believes that you threaten TolCamp's security.

7. Applicable Law and Dispute Resolution

These Terms of Payment and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Turkey. Istanbul Courts and Enforcement Offices are authorized to resolve disputes between the parties.
