Introduction
These Terms and Conditions (“Agreement”) apply to your use of the TolCamp Platform (“Platform”). The Platform is provided by TolCamp and allows users (“Members”) to list, offer, search and book travel and accommodation services. The Members who publish and offer the services are “Hosts” and the Members who search for, book or use the services are “Customers (Hosts)”.
1. Definitions
Certain terms used in this Agreement have the following meanings:
“TolCamp”: The company that owns and operates the TolCamp Platform.
“Platform”: The website, mobile application and all other related platforms provided by TolCamp.
“Services”: Refers to all services offered through the Platform.
“Host Services”: Refers to services offered by the Facility Owners, such as accommodation, activities, excursions, events and other travel services.
“Listing”: Means the advertisement of a Host Service on the Platform.
“Accommodation”: means accommodation offered by the Facility Owners.
“Experiences”: Refers to activities, excursions and events offered by the Facility Owners.
“Payment Terms”: The terms and conditions applicable to payments made through the Platform.
2. Acceptance of the Contract
By using the Platform, you acknowledge that you have read, understood and agree to be bound by this Agreement in its entirety. If you do not agree to this Agreement, you may not use the Platform.
3. The Role of TolCamp
TolCamp provides the Platform as a connecting platform between Property Owners and Customers. TolCamp does not own, control, offer or manage any Registration or Host Services. TolCamp is not a party to any direct contracts between Property Owners and Clients. TolCamp is not a real estate broker, travel agent or insurer and does not act as an agent on behalf of any Member, except as provided in the Terms of Payment.
4. Membership
4.1 Membership is required to use the Platform. By using the Platform, you represent that you are over 18 years of age or under the supervision of your parent or legal guardian and have the authority to comply with this Agreement.
4.2 You are responsible for maintaining the confidentiality of your account and password. You must notify TolCamp immediately of any unauthorized use or breach of security of your account or password.
4.3 You are responsible for providing accurate, current and complete information and for promptly updating your account to keep such information current.
4.4 TolCamp reserves the right to deny access to the Platform to any person at any time and for any reason.
5. Host Services
5.1 Facility Owners may list and offer the Facility Owner Services at their discretion. TolCamp does not guarantee the quality, security or legality of the Host Services.
5.2 Facility Owners are responsible for ensuring that all Facility Owner Services they list comply with all applicable laws and regulations.
5.3 TolCamp reserves the right to cancel the booking of any Host Service.
6. Reservations
6.1 Customers can book Host Services through the Platform. When you make a booking, you enter into a contract directly with the relevant Host.
6.2 It is your responsibility to understand and accept all terms and conditions, including cancellation policies, applicable to each Host Service.
6.3 If you have any problems with your booking, you should contact the relevant Host directly.
7. Payments
7.1 All payments made through the Platform are subject to the Payment Terms.
7.2 Facility Owners determine the applicable prices for Facility Owner Services.
8. Content
8.1 The Platform may contain content (“Content”) owned by TolCamp, its licensors or other users. This Content is protected by copyright, trademark and other intellectual property laws.
8.2 You may not copy, modify, distribute, display, publish or otherwise use the Content without TolCamp's written permission.

10. Disclaimer of Liability
The Platform is provided “as is” and “as available”. TolCamp makes no warranties of any kind, express or implied, with respect to the Platform, including, without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of Liability
TolCamp shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of the use or inability to use the Platform.
12. Compensation
You agree to defend, indemnify and hold harmless TolCamp, its officers, directors, employees, agents, licensors and suppliers from any and all claims, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or in connection with your breach of this Agreement.
13. Governing Law and Competent Court
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey. All disputes arising out of or in connection with this Agreement shall be resolved in the courts of Turkey.
14. General Provisions
This Agreement constitutes the entire agreement between you and TolCamp with respect to your use of the Platform. TolCamp reserves the right to update this Agreement at any time. If any changes are made, we will post the revised Agreement on the Platform. If you do not agree to any changes, you must stop using the Platform.
